Terms of Service

1. Introduction

These Terms govern your access to and use of Bizcopilot business messaging, AI agent, workflow automation, and related services.

2. Eligibility and Business Use

The platform is intended primarily for businesses and their authorized representatives. You must have authority to connect and manage the business accounts, WhatsApp Business Accounts, phone numbers, and other systems that you connect.

3. Services

Depending on your configuration and subscription, Bizcopilot may provide:

• WhatsApp Business Platform integrations and business messaging
• AI-powered conversational agents and automated responses
• Lead qualification and message template management
• CRM and other integration functionality
• Workflow automation, analytics, and related services

Available functionality may vary by plan, configuration, technical availability, and third-party requirements.

4. Third-Party Platforms

The service may integrate with third-party platforms, including Meta and WhatsApp. You must comply with the applicable terms, policies, and requirements of those services.

Incraax AI Automation Pvt. Limited is an independent technology provider and does not claim ownership of WhatsApp or Meta trademarks. Bizcopilot does not claim to be an official Meta or WhatsApp Partner unless that status has actually been obtained.

5. Customer Responsibilities

• Obtain appropriate customer consent where required.
• Comply with WhatsApp Business Messaging policies and applicable privacy/data protection laws.
• Use approved message templates where required.
• Avoid spam, fraud, abuse, and unlawful messaging.
• Maintain accurate account information.
• Ensure you have the rights and permissions needed for customer data you upload or process.

6. Acceptable Use

You must not use the service for spam, fraud, impersonation, phishing, unlawful content, malware, harassment, unauthorized bulk messaging, bypassing Meta or WhatsApp restrictions, unauthorized access, or misuse of customer data.

7. Account and Security

You are responsible for protecting your account credentials and for activity under your account. Notify Bizcopilot promptly if you suspect unauthorized access.

8. WhatsApp and Meta Accounts

Businesses may connect their own WhatsApp Business Account, Business Portfolio, phone number, or other Meta assets. The connected business remains responsible for those assets and compliance.

Bizcopilot cannot guarantee approval of WhatsApp Business Accounts, phone numbers, message templates, display names, messaging limits, quality ratings, Meta verification, or Meta partner status. These decisions are controlled by Meta or WhatsApp.

9. AI-Generated Responses

AI-generated content may occasionally contain errors. Customers are responsible for configuring, monitoring, and reviewing automations for their business use case. High-impact or sensitive decisions should not rely solely on automated AI responses.

10. Fees and Payments

Paid services may be governed by the selected subscription, order form, quotation, invoice, or service agreement. Prices and payment terms are those communicated in the applicable commercial document.

11. Intellectual Property

Bizcopilot retains rights to its software, user interface, workflows, documentation, and technology. Customers retain rights to their business and customer content, subject to the permissions required to provide the service. Third-party trademarks remain the property of their respective owners.

12. Privacy and Data Processing

Data processing is governed by our Privacy Policy and any applicable agreements.

13. Suspension and Termination

Bizcopilot may suspend or terminate access for policy violations, security threats, fraud, unlawful use, non-payment where applicable, or restrictions imposed by a third-party platform.

14. Service Availability

Availability may depend on third-party APIs, including Meta and WhatsApp. We do not guarantee uninterrupted or error-free service.

15. Disclaimer

The services are provided subject to applicable agreements and law. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Bizcopilot will not be liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from use of the services. Any liability that cannot be excluded will be limited as required by applicable law and the applicable commercial agreement.

17. Changes to Terms

We may update these Terms when the service or legal requirements change. The “Last Updated” date will change when an updated version is posted.

18. Governing Law

These Terms are governed by the laws of India, subject to applicable law and any separately agreed contractual terms.
